Terms and Conditions of Entry for the "There's Nothing Like Australia Dream Team Promotion" (Promotion)
1. These terms and condition of entry, including information on how to participate and prize details (Terms), apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.
2. Entry into the Promotion is also deemed as acceptance of the Promoter's Website Terms and Conditions, which can be viewed at http://www.australia.com/terms_conditions.aspx. To the extent that there is any inconsistency between these Terms and the Promoter's Website Terms and Conditions, these Terms shall prevail.
3. The Promoter is Tourism Australia (ABN 99 657 548 712) of Level 18, Tower 2 Darling Park 201 Sussex Street Sydney 2000 (Promoter). Sponsors of the Promotion are Luxury Lodges of Australia, Qantas Airways and Sony Music Entertainment (Sponsors).
4. The Promotion will be open from 9:00am Australian Eastern Standard Time (AEST) on 16 September 2011 until 11:59pm AEST on 31 October 2011 (Promotion Period) and will be run over 6 Promotional Weeks as follows (all times are AEST):
Entries that have been received by 11:59pm on the close date of the relevant Promotional Week will be eligible to be judged in that Promotional Week provided they successfully pass moderation. All entries will be moderated for compliance with these Terms before they will be judged. Moderation is anticipated to take up to 48 hours, however may take longer on some occasions. In the event that all entries received during a Promotional Week have not been moderated prior to the nominated date for the entries to be judged and the winner(s) to be selected for that Promotional Week, the dates for winner selection and winner announcement will be delayed to allow all entries submitted in that Promotional Week to be moderated. If the winner selection and winner announcement dates are delayed, an announcement will be published on www.nothinglikeaustralia.com.au. For the avoidance of any doubt, any entry that is submitted before the close date in any given Promotional Week and is deemed to be an Eligible Entry following moderation, will be eligible for judging and to win the applicable prizes offered in that particular Promotional Week.
5. Entry in the Promotion is open to Australian residents aged 18 years and over excluding:
(a) management, employees, directors and contractors of the Promoter, its related entities and other agencies, firms or companies associated with the Promotion (including suppliers of prizes); and
(b) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 5(a) of these Terms,
(Eligible Entrants).
HOW TO ENTER
6. To enter and be eligible to win, Eligible Entrants must, during the Promotion Period:
(a) complete the official competition entry form on www.nothinglikeaustralia.com.au (Entry Form) (providing all details required, including age, full name, address and day time phone number);
(b) upload a photograph taken by the Eligible Entrant in Australia in jpeg, gif, tif or png format, which is no larger than 7MB in size, and falls within one of the following categories: (i) Australian nature; (ii) Australian cities; (iii) Australian coastal lifestyle; (iv) Australian food and wine; (v) Australian Aboriginal culture; (vi) Australian outback; or (vii) Australian journey; and
(c) provide in 25 words or less (in English) a caption for the photograph, beginning with the words "There's nothing like…". The 25 words does not include the words “There’s nothing like”; and
(d) comply with the conditions set out in paragraphs 9 and 10 of these Terms
(an Eligible Entry).
7. Any entries that do not comply with the conditions set out in paragraphs 9 and 10 of the Terms, or do not include a photograph falling within one of the categories set out in paragraph 6(b) will not be an Eligible Entry.
8. Eligible Entrants may also choose to nominate up to five people who the Eligible Entrant would take with them if they won a holiday prize (Dream Team) (by providing all details required including name, suburb, state and age) and assign them roles in the Eligible Entrant’s Dream Team (note: Eligible Entrants must only nominate friends, family or colleagues with whom they have a personal relationship and who the Eligible Entrant can infer would consent to receiving an email from them. Each nominated person must be an Australian resident and must be aged 18 years or older, unless they are nominated by a parent or legal guardian (or a sibling with the consent of the parent or legal guardian) in which case the nominated person can be under 18. Some prizes have age restrictions so Eligible Entrants should read the prize details carefully before nominating someone under the age of 18 years). The referred person may then choose to enter the competition and may either create their own Dream Team, or add their entry to the existing Dream Team.
ENTRY TERMS
9. An entry may not contain, as determined by the Promoter in its sole discretion, any content that:
(a) is sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, is profane or pornographic, or contains nudity;
(b) promotes illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
(c) promotes hunting or gambling, or cruelty to animals or humans;
(d) promotes the irresponsible use of alcohol, or is obscene, offensive, inappropriate, or endorses any form of hate or hate group;
(e) contains a photograph that has already been submitted by the entrant in another entry or otherwise appears to duplicate any other submitted entries, as determined in the Promoter's sole discretion;
(f) defames, misrepresents or contains disparaging remarks about other people or companies, or contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
(g) contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission, or overt company or product branding (including URLs or phone numbers), even with permission;
(h) is a mash up of images or contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images, television, movies or other media), without permission;
(i) contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission, or contains look-alikes of celebrities or other public or private figures, living or dead;
(j) is culturally inappropriate, demeaning or derogatory to Aboriginal and Torres Strait Islander peoples. For further guidance on whether material is culturally appropriate, please refer to the Australia Council publication entitled “Protocols for producing Indigenous Australian visual arts” or contact the Australia Council on (02) 9215 9000;
(k) communicates messages or images inconsistent with the positive images and/or goodwill the Promoter wishes to associate; and/or
(l) violates any law.
10. If an entry contains images of an alcoholic beverage, including the consumption of an alcoholic beverage, entries must present a mature, balanced and responsible approach to the consumption of alcoholic beverages, and therefore must not encourage excessive consumption or abuse of alcohol and must not encourage under-age drinking. For further guidance on what is acceptable for images containing alcoholic beverages please refer to the Alcohol Beverages Advertising Code available from www.abac.org.au. Whether or not an entry complies with this paragraph 10 shall be determined by the Promoter in its sole discretion.
11. By entering the Promotion, Eligible Entrants represent and warrant that:
(a) their entry is original and they own the entry and have the right to assign or license copyright ownership and other intellectual property rights in the entry to the Promoter;
(b) their entry does not violate the privacy rights, copyright, contract rights or other rights (including but not limited to intellectual property rights) of any person, corporation or entity;
(c) their entry does not contain content, or their conduct in creating the content, was not illegal, contrary to any laws, indecent, obscene, threatening, discriminatory, harassing to any person, in breach of any confidence, defamatory, libellous, offensive or objectionable;
(d) if the entry in any way includes third parties, including Aboriginal and Torres Strait Islander peoples, or third party property, they have obtained the required consents and releases from those third parties and/or Aboriginal and Torres Strait Islander peoples (or third party property owners) to include them in their entry. For further guidance, please refer to the Australia Council publication entitled “Protocols for producing Indigenous Australian visual arts” or contact the Australia Council on (02) 9215 9000 or the relevant Aboriginal Land Council;
(e) if the entry in any way includes images of locations that require permission, permits or releases to be obtained for the commercial use of the image (including images of Aboriginal and Torres Strait Islander sacred sites), they have obtained the required consents and releases from the appropriate owners/authorities. For further guidance, please refer to the Australia Council publication entitled “Protocols for producing Indigenous Australian visual arts” or contact the Australia Council on (02) 9215 9000 or the relevant Aboriginal Land Council; and
(f) if the entry in any way includes third parties under the age of 18 years, they have obtained the required consents and releases from the parents or legal guardians (as applicable) of those third parties or the third party property owners to include them in their entry.
12. For non-winning entries: By entering the Promotion, Eligible Entrants grant Tourism Australia a non-exclusive, worldwide, royalty-free, non-transferrable licence to use, reproduce, publish, store, and communicate to the public the entry (or the photograph and/or text that forms part of the entry) on Tourism Australia owned and operated websites for a period of 5 years from the start date of the Promotion. Should the Promoter wish to use an entry in any other way (for example, in mediums other than online; for a period beyond the licence term; or to sub-licence the image with a third party), the Promoter will contact the entrant and negotiate licence terms and appropriate compensation (if appropriate, depending on the nature of the use and as determined in the Promoter's sole discretion) on a case-by-case basis. Eligible Entrants acknowledge and agree that the Promoter may edit or translate the text that forms part of the entry and that their photograph and translated text may be used on Tourism Australia owned and operated websites (including local versions of these websites overseas) for a period of 5 years from the start date of the Promotion. Entrants also acknowledge and agree that the photograph component of their entry may be retouched, resized or cropped to make the photograph suitable for display in a particular media (which would only be for display on the Promoter's websites in the case of non-winning entries). The Promoter will at all times ensure any modifications or edits to any part of the entry are minimal and maintain the original essence of the entry. Entries will be credited as per paragraph 14.
13. For winning entries: By entering the Promotion and accepting a Prize, Winners grant Tourism Australia a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, transferrable licence to use, reproduce, publish, store, modify, adapt, create derivative works from and communicate to the public the entry (or the photograph and/or text that forms part of the entry) in all media. Winners acknowledge that their entry may be used by the Promoter, the Promoter’s related entities, agencies engaged by the Promoter, or any other third party nominated by the Promoter, for the Promoter’s current and future promotional and marketing purposes without further reference or compensation to them. Winners acknowledge and agree that the Promoter may edit or translate the text that forms part of the entry and that their photograph and translated text may be used in all media in perpetuity. Winners also acknowledge and agree that the photograph component of their entry may be retouched, resized or cropped to make the photograph suitable for display in a particular media. The Promoter will at all times ensure any modifications or edits to any part of the entry are minimal and maintain the original essence of the entry. Entries will be credited as per paragraph 14.
14. The Promoter intends to credit all entries (whether winning entries or non-winning entries) displayed in any media (either on the Promoter's websites for non-winning entries or in any media for winning entries) with the Entrant’s full name (e.g. John Smith) and State/Territory of residence on websites, and the Entrant’s full name (e.g. John Smith) or first initial and last name (eg J. Smith) and State/Territory of residence on other media. If the Promoter wishes to amend or adapt an entry or do anything that would infringe the Moral Rights of an Entrant (apart from the edits / translation of the text or retouching, resizing or cropping of the photographs as outlined in Clauses 12 and 13), it will seek consent from the Entrant to do so on a case-by-case basis.
15. Eligible Entrants acknowledge that:
(a) entries may be reviewed by the Promoter to ensure that they comply with the Terms, and consequently whether they are an Eligible Entry or not, which will be decided in the Promoter's sole discretion;
(b) if the entry is deemed to be an Eligible Entry, the Promoter will send the Eligible Entrant an email confirming that their entry has been accepted and will be judged;
(c) the Promoter may notify entrants if their entry is invalid or rejected because it does not comply with these Terms, but is under no obligation to do so;
(d) the Promoter intends to post all Eligible Entries on the website located at www.nothinglikeaustralia.com.au, however the Promoter is under no obligation to post Eligible Entries to that website and makes no representation and provides no guarantee as to when Eligible Entries may be posted to that website;
(e) the Promoter has the right to use a winning entry in any media or in any way it sees fit; and
(f) if requested by the Promoter, Winners may be required to provide the Promoter with a high resolution version of the photograph submitted as part of the winning Eligible Entry.
JUDGING AND PRIZES
16. Eligible Entries received during the Promotion will be judged by a panel of representatives from the Promoter, Luxury Lodges of Australia, Qantas Airways and Sony Music Entertainment in accordance with the criteria set out in paragraph 22 on the dates set out in paragraph 4. For each Promotional Week (except Promotional Week 6 in which there will only be one First Prize winner), the panel will select one First Prize winner (best judged entry), one Second Prize winner (second best judged entry), and one Third Prize winner (third best judged entry).

First Prize:

This prize is only available on scheduled Kimberley coast trips. Trip schedule recommences March 2012. Specific cruise itinerary may change. Excludes helicopter trips.
18. If a winner’s nominated Dream Team members (as per their entry) are not able to attend the prize trip, the winner may substitute alternative travel companions. All prizes are for a maximum of six guests (the winner and up to five travel companions). If a winner has selected less than five Dream Team members on their entry, they may choose additional travel companions to attend the prize trip (to make up a maximum of five travel companions).
19. Total maximum prize value is up to $318,691 (Recommended Retail Price including GST, depending on point of departure) (i.e. the total value of the Prizes) plus the total value of all Giveaways awarded in accordance with Paragraph 29, which will be $5 (including GST) multiplied by the total number of Eligible Entries received during the Promotion Period.
20. Each Prize must be booked and travelled in full by 30 April 2012 , otherwise the entire Prize will be forfeited. Accommodation and travel is also subject to availability at the time of booking and blackout periods as stated above. No extension of the travel dates or variation to the itinerary will be permitted.
21. This is a game of skill only and chance plays no part in determining the winners.
22. Eligible Entries will be judged on the following criteria:
(a) the authentic Australian experience portrayed in the Eligible Entry;
(b) the originality and creativity of the Eligible Entry; and
(c) the relevance of the photograph to the categories listed in paragraph 6(b).
23. Winners will be:
(a) notified by phone, email or mail within 5 days of being selected; and
(b) published on www.nothinglikeaustralia.com.au on the dates set out in Paragraph 4.
24. In order to claim and/or participate in the Prize, the Prize winners may be required to provide a release and indemnity in favour of the Promoter in respect of their acceptance and use of the Prize.
25. All costs associated or arising in connection with the Prizes are the responsibility of the Prize winners. In particular, the following are not included as part of the Prizes (unless specified); transfers to and from the departure airport, laundry services, telephone calls, insurances, spending money, extra activities and other ancillary costs not specified in the prize descriptions, and these are the responsibility of the Prize winners. Winners may be required to present a credit card at time of accommodation check-in.
26. If a winner or travel companion’s usual residential address is in the capital city in which the arrival airport is based, then the flight component of the prize does not apply. If a travel companion is under 18, alcohol components of the prize do not apply and the travel companion may not be permitted to participate in some activities. The winner and travel companions may not accrue frequent flyer points from taking the Prize. Travel on prize flights is subject to Qantas’ General Conditions of Carriage. An upgrade cannot be purchased on airfares with cash or Qantas Frequent Flyer points. There can be no changes made to prize flight travel arrangements once tickets are issued.
27. Taking each Prize is subject to the prevailing terms and conditions of any providers and in particular, health, behaviour, age and safety requirements. Any part of a prize that is not taken for any reason is forfeited. No compensation will be payable if the winner, or their travel companions, are unable to use any element of the prize as stated for whatever reason, including participation in certain activities for health, behaviour or safety reasons.
28. The Promoter encourages Prize winners to enjoy alcohol in moderation and to consider the 'low risk drinking' guideline recommended in the National Health & Medical Research Council Australian Alcohol Guidelines. A full version of the guidelines is available at: http://www.nhmrc.gov.au/_files_nhmrc/publications/attachments/ds9_0.pdf. Participation in the promotion is subject to relevant liquor legislation in each applicable State or Territory, including responsible service of alcohol. Winners are also encouraged to visit the Australian Government's information site for alcohol at www.alcohol.gov.au.
29. Giveaway: Eligible Entrants who submit an Eligible Entry will receive a $5 bandit.fm voucher (Giveaway). All Eligible Entrants will receive the Giveaway in the form of a unique code sent to the entrant via email within 7 weeks of the date of their entry but not later than 4 November 2011. Eligible Entrants will be able to redeem the Giveaway by visiting the website located at www.bandit.fm and following the prompts. Redemption requires an Eligible Entrant to be, or become, a member of bandit.fm (there is no cost to become a member). Each Eligible Entry will receive a Giveaway. For the avoidance of any doubt, if an entrant enters the Promotion multiple times, they will receive one Giveaway for each Eligible Entry submitted by them. Giveaways will be valid to redeem from 15 September 2011 – 20 November 2011. Once redeemed, the $5 credit is valid for 14 days. Giveaways are subject to Sony’s prevailing terms and conditions of use which are available at www.bandit.fm. The $5 credit is inclusive of GST.
30. In accepting and using the Prizes, the Prize winners and their nominated travel companions agree to:
(a) obtain travel insurance for the duration of their participation in the Prize in an amount and from an insurer acceptable to the Promoter; and
(b) agree not to act or fail to act in a manner which brings or may in the Promoter's opinion bring the Promoter or its related entities into disrepute, during the course of their participation in the Prize.
31. Acceptance and use of Prizes is subject to terms and conditions imposed by those involved in providing goods and/or services as part of or in connection with the Prizes, including airlines and accommodation providers.
VERIFICATION
32. If requested by the Promoter, the provisional Prize winners must produce, within the time requested by the Promoter and in its absolute discretion, appropriate photo identification or other documentation (including photo identification and documentation for the parent or legal guardian of any winner aged under 18 years), required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim a Prize and compliance with these Terms before the Promoter issues their Prize. If the items required by the Promoter are not received or a provisional winning entry has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the provisional winner's entry will be deemed invalid. Prizes will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction. The Promoter also reserves the right to request the Winner’s travel companions to produce appropriate photo identification and other documentation to confirm their identity, age and residential address before issuing the Prize. In the event that the Promoter is not able to contact the Winner within 5 days after the applicable winner selection date, the contact details provided are incorrect or out of date, the Winner refuses to provide the documentation requested or the Promoter is unable to verify the Winner’s eligibility, the Winner will forfeit their Prize and no substitute or alternative Prize will be awarded. In this event, the applicable Prize will be awarded to the next best Eligible Entry as determined by the judging panel in accordance with paragraph 16.
GENERAL
33. Entrants may enter the Promotion as many times as they wish, provided each entry is different and original as required by these Terms, however, entries submitted through an automated system are prohibited and ineligible to win.
34. If an entrant submits substantially the same entry more than once or otherwise breaches paragraph 9(e) of these Terms, the Promoter may block that entrant from submitting any further entries and the entrant will be ineligible to win the Prizes.
35. Entrants can only enter the Promotion in their own name.
36. Some entries may contain Aboriginal and Torres Strait Islander words or names. As these words or names are submitted by the entrant, the Promoter is unable to ensure the correct spelling of Aboriginal and Torres Strait Islander words or names. To ensure the correct spelling of Aboriginal and Torres Strait Islander words or names entrants should refer to http://austlang.aiatsis.gov.au. Further information on Aboriginal and Torres Strait Islander peoples can be viewed at www.aiatsis.gov.au.
37. Prizes are not transferable, exchangeable or redeemable for cash. Prizes must be taken as offered and may not be varied.
38. If for any reason the Promoter is unable to provide a winner with the Prize or any component of the Prize, the Promoter reserves the right to supply an alternative prize (or component) of similar monetary value to the nominated prize or component.
39. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries. The Promoter does not warrant that the entry mechanism will be available at all times during the Promotion Period.
40. If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, including cancelling, terminating, modifying or suspending the Promotion.
41. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.
42. Incomplete, illegible, indecipherable or incorrect entries are not eligible to win.
43. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms. The Promoter's decisions in relation to all aspects of the Promotion are final and binding on each entrant and no correspondence will be entered into.
44. The Promoter collects personal information about entrants to include entrants in the Promotion and where appropriate award the Prizes. If the personal information requested is not provided, the entrant cannot participate in the Promotion. By participating in the Promotion, each entrant consents to disclosing their personal information to the Promoter and the Promoter using, and disclosing their personal information to the Promoter's related entities, the Promoter's agencies and other third parties engaged to provide services in connection with the Promotion (including suppliers of Prizes) for use for, the following purposes:
(a) contacting the entrant in relation to the Promotion;
(b) improving the Promoter's or the Promoter's related entities' goods and services; and
(c) contacting the entrant in the future for the Promoter's or the Promoter's related entities' marketing purposes via any medium including mail, telephone (regardless of whether the entrant is registered on the Do Not Call Register) and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other media including media not yet in existence at the time of the Promotion.
The entrant provides this consent until such a time as they withdraw their consent by giving notice to the Promoter. Entrants can also gain access to, update or correct any personal information held by the Promoter by contacting the Promoter by sending an email to privacy@tourism.australia.com. All personal information will be stored at the office of the Promoter.
45. Entrants acknowledge that on the entry form entrants may tick a box agreeing to the Promoter providing the entrant's personal information to the Promoter's partners for the following purposes:
(a) the Promoter's partners contacting the entrant in relation to the Promoter's partners newsletters;
(b) the Promoter's partners contacting the entrant with information on promotions and offers offered by the Promoter's partners;
or
(c) the Promoter's partners contacting the entrant in relation to the Promoter's partners general marketing purposes,
via any medium including mail, telephone (regardless of whether the entrant is registered on the Do Not Call Register) and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other media including media not yet in existence at the time of the Promotion.
46. By accepting a Prize, Winners agree and acknowledge:
(a) they may be contacted by the Promoter (or an agent of the Promoter) to provide comments about the Promotion and the Promoter (or an agent of the Promoter) may take photos or recordings of them;
(b) the Promoter may use any comments obtained from them, their name, and/or likeness and any photos or recordings taken of them (the Materials) for the Promoter's future promotional and marketing purposes without further reference or compensation to them;
(c) the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at any time, anywhere, and by any means (including communicating them to the public in any media, including media not yet in existence). The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
(d) they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose it determines;
(e) they unconditionally and irrevocably:
(i) consent to any act or omission that would otherwise infringe any of their Moral Rights in the Materials; and
(ii) waive all Moral Rights in the Materials that arise outside Australia; and
(f) they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
47. The:
(a) Promoter, the Promoter's related entities, Sponsors and all agencies associated with the Promotion; and
(b) the employees, agents, directors and contractors, of all entities referred to in paragraph 47(a),
shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of, or participation in, the Prize, whether as a result of negligence, a breach of statutory duty or otherwise, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
48. The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of the Prizes.
49. Each entrant acknowledges and agrees that it is a condition of participation in the Promotion that the entrant be capable of agreeing to these Terms and giving the consents contained herein.

2. Entry into the Promotion is also deemed as acceptance of the Promoter's Website Terms and Conditions, which can be viewed at http://www.australia.com/terms_conditions.aspx. To the extent that there is any inconsistency between these Terms and the Promoter's Website Terms and Conditions, these Terms shall prevail.
3. The Promoter is Tourism Australia (ABN 99 657 548 712) of Level 18, Tower 2 Darling Park 201 Sussex Street Sydney 2000 (Promoter). Sponsors of the Promotion are Luxury Lodges of Australia, Qantas Airways and Sony Music Entertainment (Sponsors).
4. The Promotion will be open from 9:00am Australian Eastern Standard Time (AEST) on 16 September 2011 until 11:59pm AEST on 31 October 2011 (Promotion Period) and will be run over 6 Promotional Weeks as follows (all times are AEST):

Entries that have been received by 11:59pm on the close date of the relevant Promotional Week will be eligible to be judged in that Promotional Week provided they successfully pass moderation. All entries will be moderated for compliance with these Terms before they will be judged. Moderation is anticipated to take up to 48 hours, however may take longer on some occasions. In the event that all entries received during a Promotional Week have not been moderated prior to the nominated date for the entries to be judged and the winner(s) to be selected for that Promotional Week, the dates for winner selection and winner announcement will be delayed to allow all entries submitted in that Promotional Week to be moderated. If the winner selection and winner announcement dates are delayed, an announcement will be published on www.nothinglikeaustralia.com.au. For the avoidance of any doubt, any entry that is submitted before the close date in any given Promotional Week and is deemed to be an Eligible Entry following moderation, will be eligible for judging and to win the applicable prizes offered in that particular Promotional Week.
5. Entry in the Promotion is open to Australian residents aged 18 years and over excluding:
(a) management, employees, directors and contractors of the Promoter, its related entities and other agencies, firms or companies associated with the Promotion (including suppliers of prizes); and
(b) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 5(a) of these Terms,
(Eligible Entrants).
HOW TO ENTER
6. To enter and be eligible to win, Eligible Entrants must, during the Promotion Period:
(a) complete the official competition entry form on www.nothinglikeaustralia.com.au (Entry Form) (providing all details required, including age, full name, address and day time phone number);
(b) upload a photograph taken by the Eligible Entrant in Australia in jpeg, gif, tif or png format, which is no larger than 7MB in size, and falls within one of the following categories: (i) Australian nature; (ii) Australian cities; (iii) Australian coastal lifestyle; (iv) Australian food and wine; (v) Australian Aboriginal culture; (vi) Australian outback; or (vii) Australian journey; and
(c) provide in 25 words or less (in English) a caption for the photograph, beginning with the words "There's nothing like…". The 25 words does not include the words “There’s nothing like”; and
(d) comply with the conditions set out in paragraphs 9 and 10 of these Terms
(an Eligible Entry).
7. Any entries that do not comply with the conditions set out in paragraphs 9 and 10 of the Terms, or do not include a photograph falling within one of the categories set out in paragraph 6(b) will not be an Eligible Entry.
8. Eligible Entrants may also choose to nominate up to five people who the Eligible Entrant would take with them if they won a holiday prize (Dream Team) (by providing all details required including name, suburb, state and age) and assign them roles in the Eligible Entrant’s Dream Team (note: Eligible Entrants must only nominate friends, family or colleagues with whom they have a personal relationship and who the Eligible Entrant can infer would consent to receiving an email from them. Each nominated person must be an Australian resident and must be aged 18 years or older, unless they are nominated by a parent or legal guardian (or a sibling with the consent of the parent or legal guardian) in which case the nominated person can be under 18. Some prizes have age restrictions so Eligible Entrants should read the prize details carefully before nominating someone under the age of 18 years). The referred person may then choose to enter the competition and may either create their own Dream Team, or add their entry to the existing Dream Team.
ENTRY TERMS
9. An entry may not contain, as determined by the Promoter in its sole discretion, any content that:
(a) is sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, is profane or pornographic, or contains nudity;
(b) promotes illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
(c) promotes hunting or gambling, or cruelty to animals or humans;
(d) promotes the irresponsible use of alcohol, or is obscene, offensive, inappropriate, or endorses any form of hate or hate group;
(e) contains a photograph that has already been submitted by the entrant in another entry or otherwise appears to duplicate any other submitted entries, as determined in the Promoter's sole discretion;
(f) defames, misrepresents or contains disparaging remarks about other people or companies, or contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
(g) contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission, or overt company or product branding (including URLs or phone numbers), even with permission;
(h) is a mash up of images or contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images, television, movies or other media), without permission;
(i) contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission, or contains look-alikes of celebrities or other public or private figures, living or dead;
(j) is culturally inappropriate, demeaning or derogatory to Aboriginal and Torres Strait Islander peoples. For further guidance on whether material is culturally appropriate, please refer to the Australia Council publication entitled “Protocols for producing Indigenous Australian visual arts” or contact the Australia Council on (02) 9215 9000;
(k) communicates messages or images inconsistent with the positive images and/or goodwill the Promoter wishes to associate; and/or
(l) violates any law.
10. If an entry contains images of an alcoholic beverage, including the consumption of an alcoholic beverage, entries must present a mature, balanced and responsible approach to the consumption of alcoholic beverages, and therefore must not encourage excessive consumption or abuse of alcohol and must not encourage under-age drinking. For further guidance on what is acceptable for images containing alcoholic beverages please refer to the Alcohol Beverages Advertising Code available from www.abac.org.au. Whether or not an entry complies with this paragraph 10 shall be determined by the Promoter in its sole discretion.
11. By entering the Promotion, Eligible Entrants represent and warrant that:
(a) their entry is original and they own the entry and have the right to assign or license copyright ownership and other intellectual property rights in the entry to the Promoter;
(b) their entry does not violate the privacy rights, copyright, contract rights or other rights (including but not limited to intellectual property rights) of any person, corporation or entity;
(c) their entry does not contain content, or their conduct in creating the content, was not illegal, contrary to any laws, indecent, obscene, threatening, discriminatory, harassing to any person, in breach of any confidence, defamatory, libellous, offensive or objectionable;
(d) if the entry in any way includes third parties, including Aboriginal and Torres Strait Islander peoples, or third party property, they have obtained the required consents and releases from those third parties and/or Aboriginal and Torres Strait Islander peoples (or third party property owners) to include them in their entry. For further guidance, please refer to the Australia Council publication entitled “Protocols for producing Indigenous Australian visual arts” or contact the Australia Council on (02) 9215 9000 or the relevant Aboriginal Land Council;
(e) if the entry in any way includes images of locations that require permission, permits or releases to be obtained for the commercial use of the image (including images of Aboriginal and Torres Strait Islander sacred sites), they have obtained the required consents and releases from the appropriate owners/authorities. For further guidance, please refer to the Australia Council publication entitled “Protocols for producing Indigenous Australian visual arts” or contact the Australia Council on (02) 9215 9000 or the relevant Aboriginal Land Council; and
(f) if the entry in any way includes third parties under the age of 18 years, they have obtained the required consents and releases from the parents or legal guardians (as applicable) of those third parties or the third party property owners to include them in their entry.
12. For non-winning entries: By entering the Promotion, Eligible Entrants grant Tourism Australia a non-exclusive, worldwide, royalty-free, non-transferrable licence to use, reproduce, publish, store, and communicate to the public the entry (or the photograph and/or text that forms part of the entry) on Tourism Australia owned and operated websites for a period of 5 years from the start date of the Promotion. Should the Promoter wish to use an entry in any other way (for example, in mediums other than online; for a period beyond the licence term; or to sub-licence the image with a third party), the Promoter will contact the entrant and negotiate licence terms and appropriate compensation (if appropriate, depending on the nature of the use and as determined in the Promoter's sole discretion) on a case-by-case basis. Eligible Entrants acknowledge and agree that the Promoter may edit or translate the text that forms part of the entry and that their photograph and translated text may be used on Tourism Australia owned and operated websites (including local versions of these websites overseas) for a period of 5 years from the start date of the Promotion. Entrants also acknowledge and agree that the photograph component of their entry may be retouched, resized or cropped to make the photograph suitable for display in a particular media (which would only be for display on the Promoter's websites in the case of non-winning entries). The Promoter will at all times ensure any modifications or edits to any part of the entry are minimal and maintain the original essence of the entry. Entries will be credited as per paragraph 14.
13. For winning entries: By entering the Promotion and accepting a Prize, Winners grant Tourism Australia a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, transferrable licence to use, reproduce, publish, store, modify, adapt, create derivative works from and communicate to the public the entry (or the photograph and/or text that forms part of the entry) in all media. Winners acknowledge that their entry may be used by the Promoter, the Promoter’s related entities, agencies engaged by the Promoter, or any other third party nominated by the Promoter, for the Promoter’s current and future promotional and marketing purposes without further reference or compensation to them. Winners acknowledge and agree that the Promoter may edit or translate the text that forms part of the entry and that their photograph and translated text may be used in all media in perpetuity. Winners also acknowledge and agree that the photograph component of their entry may be retouched, resized or cropped to make the photograph suitable for display in a particular media. The Promoter will at all times ensure any modifications or edits to any part of the entry are minimal and maintain the original essence of the entry. Entries will be credited as per paragraph 14.
14. The Promoter intends to credit all entries (whether winning entries or non-winning entries) displayed in any media (either on the Promoter's websites for non-winning entries or in any media for winning entries) with the Entrant’s full name (e.g. John Smith) and State/Territory of residence on websites, and the Entrant’s full name (e.g. John Smith) or first initial and last name (eg J. Smith) and State/Territory of residence on other media. If the Promoter wishes to amend or adapt an entry or do anything that would infringe the Moral Rights of an Entrant (apart from the edits / translation of the text or retouching, resizing or cropping of the photographs as outlined in Clauses 12 and 13), it will seek consent from the Entrant to do so on a case-by-case basis.
15. Eligible Entrants acknowledge that:
(a) entries may be reviewed by the Promoter to ensure that they comply with the Terms, and consequently whether they are an Eligible Entry or not, which will be decided in the Promoter's sole discretion;
(b) if the entry is deemed to be an Eligible Entry, the Promoter will send the Eligible Entrant an email confirming that their entry has been accepted and will be judged;
(c) the Promoter may notify entrants if their entry is invalid or rejected because it does not comply with these Terms, but is under no obligation to do so;
(d) the Promoter intends to post all Eligible Entries on the website located at www.nothinglikeaustralia.com.au, however the Promoter is under no obligation to post Eligible Entries to that website and makes no representation and provides no guarantee as to when Eligible Entries may be posted to that website;
(e) the Promoter has the right to use a winning entry in any media or in any way it sees fit; and
(f) if requested by the Promoter, Winners may be required to provide the Promoter with a high resolution version of the photograph submitted as part of the winning Eligible Entry.
JUDGING AND PRIZES
16. Eligible Entries received during the Promotion will be judged by a panel of representatives from the Promoter, Luxury Lodges of Australia, Qantas Airways and Sony Music Entertainment in accordance with the criteria set out in paragraph 22 on the dates set out in paragraph 4. For each Promotional Week (except Promotional Week 6 in which there will only be one First Prize winner), the panel will select one First Prize winner (best judged entry), one Second Prize winner (second best judged entry), and one Third Prize winner (third best judged entry).

18. If a winner’s nominated Dream Team members (as per their entry) are not able to attend the prize trip, the winner may substitute alternative travel companions. All prizes are for a maximum of six guests (the winner and up to five travel companions). If a winner has selected less than five Dream Team members on their entry, they may choose additional travel companions to attend the prize trip (to make up a maximum of five travel companions).
19. Total maximum prize value is up to $318,691 (Recommended Retail Price including GST, depending on point of departure) (i.e. the total value of the Prizes) plus the total value of all Giveaways awarded in accordance with Paragraph 29, which will be $5 (including GST) multiplied by the total number of Eligible Entries received during the Promotion Period.
20. Each Prize must be booked and travelled in full by 30 April 2012 , otherwise the entire Prize will be forfeited. Accommodation and travel is also subject to availability at the time of booking and blackout periods as stated above. No extension of the travel dates or variation to the itinerary will be permitted.
21. This is a game of skill only and chance plays no part in determining the winners.
22. Eligible Entries will be judged on the following criteria:
(a) the authentic Australian experience portrayed in the Eligible Entry;
(b) the originality and creativity of the Eligible Entry; and
(c) the relevance of the photograph to the categories listed in paragraph 6(b).
23. Winners will be:
(a) notified by phone, email or mail within 5 days of being selected; and
(b) published on www.nothinglikeaustralia.com.au on the dates set out in Paragraph 4.
24. In order to claim and/or participate in the Prize, the Prize winners may be required to provide a release and indemnity in favour of the Promoter in respect of their acceptance and use of the Prize.
25. All costs associated or arising in connection with the Prizes are the responsibility of the Prize winners. In particular, the following are not included as part of the Prizes (unless specified); transfers to and from the departure airport, laundry services, telephone calls, insurances, spending money, extra activities and other ancillary costs not specified in the prize descriptions, and these are the responsibility of the Prize winners. Winners may be required to present a credit card at time of accommodation check-in.
26. If a winner or travel companion’s usual residential address is in the capital city in which the arrival airport is based, then the flight component of the prize does not apply. If a travel companion is under 18, alcohol components of the prize do not apply and the travel companion may not be permitted to participate in some activities. The winner and travel companions may not accrue frequent flyer points from taking the Prize. Travel on prize flights is subject to Qantas’ General Conditions of Carriage. An upgrade cannot be purchased on airfares with cash or Qantas Frequent Flyer points. There can be no changes made to prize flight travel arrangements once tickets are issued.
27. Taking each Prize is subject to the prevailing terms and conditions of any providers and in particular, health, behaviour, age and safety requirements. Any part of a prize that is not taken for any reason is forfeited. No compensation will be payable if the winner, or their travel companions, are unable to use any element of the prize as stated for whatever reason, including participation in certain activities for health, behaviour or safety reasons.
28. The Promoter encourages Prize winners to enjoy alcohol in moderation and to consider the 'low risk drinking' guideline recommended in the National Health & Medical Research Council Australian Alcohol Guidelines. A full version of the guidelines is available at: http://www.nhmrc.gov.au/_files_nhmrc/publications/attachments/ds9_0.pdf. Participation in the promotion is subject to relevant liquor legislation in each applicable State or Territory, including responsible service of alcohol. Winners are also encouraged to visit the Australian Government's information site for alcohol at www.alcohol.gov.au.
29. Giveaway: Eligible Entrants who submit an Eligible Entry will receive a $5 bandit.fm voucher (Giveaway). All Eligible Entrants will receive the Giveaway in the form of a unique code sent to the entrant via email within 7 weeks of the date of their entry but not later than 4 November 2011. Eligible Entrants will be able to redeem the Giveaway by visiting the website located at www.bandit.fm and following the prompts. Redemption requires an Eligible Entrant to be, or become, a member of bandit.fm (there is no cost to become a member). Each Eligible Entry will receive a Giveaway. For the avoidance of any doubt, if an entrant enters the Promotion multiple times, they will receive one Giveaway for each Eligible Entry submitted by them. Giveaways will be valid to redeem from 15 September 2011 – 20 November 2011. Once redeemed, the $5 credit is valid for 14 days. 30. In accepting and using the Prizes, the Prize winners and their nominated travel companions agree to:
(a) obtain travel insurance for the duration of their participation in the Prize in an amount and from an insurer acceptable to the Promoter; and
(b) agree not to act or fail to act in a manner which brings or may in the Promoter's opinion bring the Promoter or its related entities into disrepute, during the course of their participation in the Prize.
31. Acceptance and use of Prizes is subject to terms and conditions imposed by those involved in providing goods and/or services as part of or in connection with the Prizes, including airlines and accommodation providers.
VERIFICATION
32. If requested by the Promoter, the provisional Prize winners must produce, within the time requested by the Promoter and in its absolute discretion, appropriate photo identification or other documentation (including photo identification and documentation for the parent or legal guardian of any winner aged under 18 years), required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim a Prize and compliance with these Terms before the Promoter issues their Prize. If the items required by the Promoter are not received or a provisional winning entry has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the provisional winner's entry will be deemed invalid. Prizes will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction. The Promoter also reserves the right to request the Winner’s travel companions to produce appropriate photo identification and other documentation to confirm their identity, age and residential address before issuing the Prize. In the event that the Promoter is not able to contact the Winner within 5 days after the applicable winner selection date, the contact details provided are incorrect or out of date, the Winner refuses to provide the documentation requested or the Promoter is unable to verify the Winner’s eligibility, the Winner will forfeit their Prize and no substitute or alternative Prize will be awarded. In this event, the applicable Prize will be awarded to the next best Eligible Entry as determined by the judging panel in accordance with paragraph 16.
GENERAL
33. Entrants may enter the Promotion as many times as they wish, provided each entry is different and original as required by these Terms, however, entries submitted through an automated system are prohibited and ineligible to win.
34. If an entrant submits substantially the same entry more than once or otherwise breaches paragraph 9(e) of these Terms, the Promoter may block that entrant from submitting any further entries and the entrant will be ineligible to win the Prizes.
35. Entrants can only enter the Promotion in their own name.
36. Some entries may contain Aboriginal and Torres Strait Islander words or names. As these words or names are submitted by the entrant, the Promoter is unable to ensure the correct spelling of Aboriginal and Torres Strait Islander words or names. To ensure the correct spelling of Aboriginal and Torres Strait Islander words or names entrants should refer to http://austlang.aiatsis.gov.au. Further information on Aboriginal and Torres Strait Islander peoples can be viewed at www.aiatsis.gov.au.
37. Prizes are not transferable, exchangeable or redeemable for cash. Prizes must be taken as offered and may not be varied.
38. If for any reason the Promoter is unable to provide a winner with the Prize or any component of the Prize, the Promoter reserves the right to supply an alternative prize (or component) of similar monetary value to the nominated prize or component.
39. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries. The Promoter does not warrant that the entry mechanism will be available at all times during the Promotion Period.
40. If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, including cancelling, terminating, modifying or suspending the Promotion.
41. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.
42. Incomplete, illegible, indecipherable or incorrect entries are not eligible to win.
43. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms. The Promoter's decisions in relation to all aspects of the Promotion are final and binding on each entrant and no correspondence will be entered into.
44. The Promoter collects personal information about entrants to include entrants in the Promotion and where appropriate award the Prizes. If the personal information requested is not provided, the entrant cannot participate in the Promotion. By participating in the Promotion, each entrant consents to disclosing their personal information to the Promoter and the Promoter using, and disclosing their personal information to the Promoter's related entities, the Promoter's agencies and other third parties engaged to provide services in connection with the Promotion (including suppliers of Prizes) for use for, the following purposes:
(a) contacting the entrant in relation to the Promotion;
(b) improving the Promoter's or the Promoter's related entities' goods and services; and
(c) contacting the entrant in the future for the Promoter's or the Promoter's related entities' marketing purposes via any medium including mail, telephone (regardless of whether the entrant is registered on the Do Not Call Register) and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other media including media not yet in existence at the time of the Promotion.
The entrant provides this consent until such a time as they withdraw their consent by giving notice to the Promoter. Entrants can also gain access to, update or correct any personal information held by the Promoter by contacting the Promoter by sending an email to privacy@tourism.australia.com. All personal information will be stored at the office of the Promoter.
45. Entrants acknowledge that on the entry form entrants may tick a box agreeing to the Promoter providing the entrant's personal information to the Promoter's partners for the following purposes:
(a) the Promoter's partners contacting the entrant in relation to the Promoter's partners newsletters;
(b) the Promoter's partners contacting the entrant with information on promotions and offers offered by the Promoter's partners;
or
(c) the Promoter's partners contacting the entrant in relation to the Promoter's partners general marketing purposes,
via any medium including mail, telephone (regardless of whether the entrant is registered on the Do Not Call Register) and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other media including media not yet in existence at the time of the Promotion.
46. By accepting a Prize, Winners agree and acknowledge:
(a) they may be contacted by the Promoter (or an agent of the Promoter) to provide comments about the Promotion and the Promoter (or an agent of the Promoter) may take photos or recordings of them;
(b) the Promoter may use any comments obtained from them, their name, and/or likeness and any photos or recordings taken of them (the Materials) for the Promoter's future promotional and marketing purposes without further reference or compensation to them;
(c) the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at any time, anywhere, and by any means (including communicating them to the public in any media, including media not yet in existence). The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
(d) they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose it determines;
(e) they unconditionally and irrevocably:
(i) consent to any act or omission that would otherwise infringe any of their Moral Rights in the Materials; and
(ii) waive all Moral Rights in the Materials that arise outside Australia; and
(f) they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
47. The:
(a) Promoter, the Promoter's related entities, Sponsors and all agencies associated with the Promotion; and
(b) the employees, agents, directors and contractors, of all entities referred to in paragraph 47(a),
shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of, or participation in, the Prize, whether as a result of negligence, a breach of statutory duty or otherwise, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
48. The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of the Prizes.
49. Each entrant acknowledges and agrees that it is a condition of participation in the Promotion that the entrant be capable of agreeing to these Terms and giving the consents contained herein.
